Solicitud de nulidad de la Sentencia SU.235/16.
Los peticionarios adujeron que la providencia en mención vulneró su derecho al debido proceso, dado que no fueron vinculados al trámite que se adelantó, pese a tener un interés legítimo en el resultado del mismo por fungir como propietarios de los predios que el INCORA les adjudicó y los cuales están a punto de perder.
La Corte concluye que en este caso no se omitió el deber de notificar a terceros con interés legítimo, pues ni el debate jurídico estaba dirigido a discutir la propiedad de los incidentantes, ni los solicitantes de la nulidad debían resultar afectados por las órdenes proferidas por la Corte Constitucional en la Sentencia SU. 235/16.
En consecuencia, al no encontrarse acreditada la causal de nulidad invocada, se NIEGA la misma.
